An AP Officer suspected of raping and chopping off the hand of a 21 year’s female student at Kibabii university has been arraigned in court but did not take a plea.
Constable Eric Mutama of Tuuti Ap camp in Kibabii location, Bungoma South sub county, Bungoma County was arraigned in court on Monday November 25, 2019.
The accused didn’t take a plea before the resident magistrate Wamboi Githongori has the investigation officer Nicholas Oluoch in a sworn affidavit requested for the seven days to hold the suspect before he completes his investigation.
The prosecution side stated that the investigations were not complete because the complainant had not recorded the statement owing to her unstable condition.
“Your honour from the sworn affidavit, the complainant who is admitted at St Luke’s hospital in Eldoret is not in stable condition and has therefore not recorded any statement, the investigative officer also wants the DNA conducted to establish if the accused person is indeed responsible for the offense before he is brought back and be charged,” said the prosecution side.
Oluoch also asked the court to let the accused person be held at Bungoma South police station until he completes his investigations so that he is properly charged.

The accused person asked the court to consider reducing the number of days a request that the court denied.

“Your honour, seven days are more for an investigation, could you please consider reducing it so that I return here this week?,” he posed.
The court was told that the officer was arrested on Friday November 22 after he allegedly attacked raped and severed off the left hand of his girlfriend after he suspected her of having another relationship with a club DJ.
The incident took place on Thursday night as the victim and his friends left a popular club after a night of clubbing. The victim who hails from Kirinyaga is a third year student majoring in Renewable Energy at Kibabii University.
“It is suspected that the accused person was not happy with how his girlfriend conducted herself with the club’s DJ and this got him annoyed and he followed and attacked, raped and chopped off her hand in a crime of passion as a way of revenging,” said the familiar source.
He will be charged in court on December 3, 2019.
